    It became prohibited under the 14th Amendment, which extended the ban on government churches to the state governments as well.

    Just because state churches weren't prohibited the day the Constitution was ratified, that doesn't mean they didn't become prohibited later on. Honestly, why are so many people ignorant of history?

    Justice Thomas is right on this. Congress can establish no religion. States could and, at the start of this country, did. I don't think it will happen, but this is not prohibited.
