I believe you are right Chad. In a traffic court we have a chance to use their system against them. Because the battle is not worth a couple hundred bucks. In a federal court for tax evasion we might as well wave good-bye to our loved ones. They are extortionists and thieves and don't even follow their own rules.

Legally the Act of 1871 cannot be enforced and therefore we are not slaves but members of a free republic where we cannot be constrained in doing business by being forced to license ourselves nor can we be made to purchase Obamacare. That however is like saying a black man in southern Georgia in 1850 is a free man. He may be but to wander around at that time would be to invite the local constabulary and all others to condemn him to slavery anyway. The facts are; all the enforcers, the courts, the legislators and 98% of all the people you are in contact with will use violence to ensure you do not abrogate the rules until you convince the slaveholders to let you be free. If you dare act free you will soon find out that none of those mentioned believe you are free and therefore you are not.

If those who are entrusted to use the violence of the state to inflict its punishments on the slaves believe it that is all that matters. Whether the slaves understand how the 'system' is used against them is irrelevant to the fact that the slaves will accept what is done to them as long as it has the appearance of being legitimate and they must obey.

Agenda31.com. I've been following him for a while and very interested to learn all on the topic, since my kids were not volunteered into Federal system yet.

This is OK if you have nothing better to do. At present, I am "retired" but, I am behind on my book list with 8 of them unread and likely a dozen more if I live long enough. Then, there's my email and various contributions to certain blogs and webs. Then there is the more mundane things such as taking care of the everyday responsibilities, such as paying bills, etc.Then there is keeping up with the culture; concerts, movies, stage presentations, lectures and various presentations. So..as you can see, playing with the police certainly would be a low grade option. I don't claim to be doing all these things all the time but while I do try, I rarely succeed.

I am not a lawyer. Nor have I the slightest desire to be one. If we're talking traffic ticket(s) then, OK. Car theft - I can recommend someone. By the way, so can you. There'so much info on the internet that picking out a good --anything -- Is pretty easy.

Hi herb, I had a traffic ticket in mind. Are you knowledgeable in law? Would like to get an expert's opinion. I believe no court case can proceed until the defendant is positively identified. Should be good for you if you can prove you are not the named defendant. They can issue a warrant for the all caps name. You can send an affidavit to the court saying you were there and the court did not find the named defendant. Would be interesting. I think it would be fun to try this in traffic court.

If you are talking about a low consequence misdemeanor, and have time on your hands, you might try this ploy. I doubt if you'll be successful, but have fun. However, if your life is at stake, not only death, but loss of wealth or lifestyle, I think you should get the best lawyer you can afford.

I'd be surprised. From what I've heard the Federal judges do just about what they want to do. Maybe if you could convince a jury.

I think I read about someone who was charged with income tax evasion and this woman if I remember right used this idea as a successful defense.

You have to know this cold and stand your ground. Because I am physically there is proof
I'm not the named defendant.(that person has no physical body) If I state I have never agreed to be the agent for the named defendant the judge can't connect me to the named defendant.I'm guessing the judge will not like this and try to get me to plead. I can't plead because I'm not the named defendant. Only that person or their agent can plead. The judge may try to plead for the named defendant. I would object and say the Separation of powers forbids any official from being both Judicial and Executive branches of the government. All this sounds nice, but in court the judge most likely will not be nice and try to bulldoze over me or trick me some other way. The important thing about this post is now there is proof we the living are not the all caps name. The name on your driver's license and your bank account is not you !

Many sites say your all caps name isn't you. It's a government trick, it's your strawman and on and on, but they never give proof. Well, I have found the significance of the all caps name. There is a legal maxim "of Likes" Stating, "Different things ought not be put together." In a court action, paper ( a legal entity, corporation) may face paper. Flesh (living person) may face flesh. But paper may not face flesh. When you go in for a traffic ticket the named defendant is your all caps name. The plaintiff is "The people of somewhere" (a corporation) paper. Your all caps name must be paper also. You are flesh and can't be a paper person. I believe this proves beyond a reasonable doubt the all caps name is a legal entity created by the government to bring you into it's statutory court system. There it can take you $ for victimless crimes. I give permission for anyone to use this info. Spread it far and wide.
