Supreme Court Denies Trump Administration Request to Reinstate Asylum Ban
Chief Justice John Roberts is the swing vote in latest legal setback for the president’s immigration policy.

A federal judge in San Francisco last month blocked enforcement of the ban for now, finding the Trump administration’s efforts likely contravened the law because Congress has said immigrants can seek asylum no matter how they come to the U.S. A federal appeals court agreed.
The emergency appeal produce a clear split at the Supreme Court. The justices, as is customary for emergency appeals, didn’t explain their reasoning, but four conservatives—Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh—registered a dissent, saying in one sentence they would have allowed the administration to implement the ban for now.

That means Chief Justice John Roberts joined the court’s four liberal justices in forming a majority to deny the government’s request.

Well, no worries: Roberts will make up for the confirmation of Kavanaugh.

What a jerk!

    He probably made a deal with the left that he'd be protected from prosecution as long as he sides with the liberals on the Court.

    That is why I think that the Kavanaugh appointment is not necessarily a means to a conservative Court. With Roberts consistently voting with the left, there is no gain on the conservative side. If Trump is able to install another constitutionalist replacing RBG, then we may have a reliable SCOTUS.

    Hence the wall. It will be a discouragement and limit the number. But we still have the problem of Visa overstays because if you are standing in the United States you have full access to the legal system and all the constitutional rights of citizens.

    I kind of agree with you. The problem is going to be to find a squeaky clean judge who is actually a constitutionalist. Electing trump gave us a brief respite from collectivism, but the leftists will have learned by 2020 how to defeat him. Any constitutionalist majority will disappear over time as the country turns to collectivism

    That should be the rule.

    But I am not holding my breath.

    For starters, any nominee by Trump will have a blistering confirmation process. Kavanaugh's was and indication.

    Second, assuming he/she is confirmed, the dynamics of the Court may change. Adding another conservative may not work the way we expect. Kavanaugh sided with Roberts recently against the conservative block.

    I can't see how Trump could unilaterally change law. The law actually states that you can apply for asylum within 1 year of your entry to the U.S. or expiration of your Visa. Congress clearly provided for you still being able to apply even if you entered illegally. So I can't really fault Roberts.

    The solution to me is to expedite the process so that someone is usually only here a couple of days before getting a ruling.

    The statist politicians also appear to use use character necktie parties to execute their opponents reputations without evidence, e.g., the recent confirmation hearings of potential supreme court justices and attempts to remove the current president before the next election.

    Roberts wanted to demonstrate there were no Obama or Trump judges, in a rebuke to Trump's opining that an Obama judge on the 9th ruled against asylum seekers.

    Roberts knows all too well that THERE ARE OBAMA judges and the fact that he joined the liberal left here to prove his point reflects poorly on him.

    It looked like "to hell with the country" when I want to make a point.

    His ACA decision was a harbinger of what is to come. I was willing to give him the benefit of the doubt after that but now he is solidifying his liberal beliefs

    He will be invited to many parties in DC after this.
